1. About Us and Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the game server hosting services provided by Server Heron V.O.F., a company registered in the Netherlands with Chamber of Commerce (KVK) number 97570788 (hereinafter "Server Heron", "we", "us", or "our").
By creating an account or using our platform at serverheron.com, you agree to be bound by these Terms in full. If you do not agree, you must not use our services.
These Terms constitute a legally binding agreement between you and Server Heron under Dutch law. Our services are intended for users aged 16 and older. By creating an account, you confirm that you are at least 16 years of age.
2. Description of Services
Server Heron provides cloud-based game server hosting, including but not limited to:
- Provisioning and management of game server instances
- A web-based control panel for server configuration and administration
- Automated server deployment on dedicated virtual infrastructure located within the European Union
- Customer support via our ticketing system
- Access to our knowledge base documentation
We reserve the right to modify, expand, or discontinue any part of our services at any time, with reasonable notice where feasible. We will inform you of significant changes via email or a platform notice.
3. Account Registration and Security
To use our services you must register an account. You agree to:
- Provide accurate, complete, and current registration information
- Keep your password secure and not share it with any third party
- Notify us immediately at [email protected] if you become aware of any unauthorised use of your account
- Be solely responsible for all activity that occurs under your account
We recommend enabling two-factor authentication (2FA) for additional account security. Server Heron will never ask you for your password via email, chat, or any channel other than the login form.
4. Acceptable Use Policy
You may only use Server Heron services for lawful purposes. You must not use our infrastructure to:
- Host, distribute, or facilitate illegal content under Dutch or EU law
- Launch distributed denial-of-service (DDoS) attacks or any network abuse targeting other parties
- Mine cryptocurrency or run non-game workloads that are not related to the provisioned service
- Attempt to gain unauthorised access to other servers, systems, or accounts
- Send unsolicited commercial communications (spam) originating from your server
- Violate the intellectual property rights of any third party, including game publishers
- Resell or sublease server resources to third parties without prior written consent
Violation of this policy may result in immediate suspension or termination of your account without a refund. We reserve the right to investigate suspected abuse and to cooperate with law enforcement where required.
5. Payment, Billing, and Subscriptions
Pricing
- All prices are displayed in euros (EUR). VAT is calculated at checkout based on your location
- Subscription fees are billed in advance on a recurring basis (monthly or as otherwise stated)
- We reserve the right to change our pricing with at least 30 days' prior notice
Payment processing
- Payments are processed by our PCI-DSS-certified third-party payment provider
- We do not store your full card number; payment credentials are handled entirely by the payment processor
- You authorise us to charge your chosen payment method on each billing date
Refunds and cancellations
- We offer a 3-day money-back guarantee on all new subscriptions. If you are not satisfied, you may request a full refund within 3 days of your initial purchase by contacting us via email at [email protected], our support ticket system, or our Discord server
- You may cancel your subscription at any time through the platform; cancellation takes effect at the end of the current billing period
- Outside the 3-day money-back period, no refunds are issued for partial billing periods unless required by applicable Dutch consumer law
- We reserve the right to deny refund requests from accounts that show patterns of abuse, such as repeated purchases with no intent to use the service, creating multiple accounts to circumvent refund limits, or requesting refunds under false pretences
Failed payments
- If a payment fails, we will notify you and attempt to retry within a reasonable period
- Continued failure to pay may result in suspension or termination of your server
6. Service Availability and Uptime
We strive to maintain high availability for all game servers. However, we do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance where possible. We shall not be liable for service interruptions caused by:
- Scheduled or emergency maintenance
- Force majeure events (natural disasters, cyberattacks, governmental actions, etc.)
- Third-party infrastructure failures outside our reasonable control
- Your own configuration errors or misuse
We target a 99.5% monthly uptime for all game servers. If your server's uptime falls below 99.5% in a calendar month due to issues attributable to Server Heron, you are entitled to a pro-rata service credit for the affected downtime. To claim a credit, contact us at [email protected] within 14 days of the affected month. Credits are applied to your next billing cycle and do not have a cash value.
7. Termination and Suspension
By you: You may terminate your account at any time by cancelling all active subscriptions and requesting account deletion via [email protected].
By us: We may suspend or terminate your account immediately and without notice if:
- You breach these Terms or our Acceptable Use Policy
- We are required to do so by law or a court order
- Your account poses a security or technical risk to our platform or other customers
- Payment is overdue and remains unresolved after reasonable notice
Upon termination, your access to the platform and all server data will cease. Server data is deleted within 30 days of account closure unless a legal retention obligation applies.
8. Intellectual Property
All content on the Server Heron platform — including the website design, software, logos, and documentation — is the intellectual property of Server Heron or its licensors and is protected under Dutch and EU intellectual property law. You may not copy, reproduce, or redistribute any platform content without our written permission.
Game titles, logos, and trademarks referenced on our platform (e.g. Minecraft®) are the property of their respective owners. Server Heron is not affiliated with or endorsed by those rights holders. Your use of game software on your server is subject to the respective publisher's end-user licence agreement (EULA).
9. Limitation of Liability
To the fullest extent permitted by Dutch law, Server Heron's total liability to you for any claim arising out of or relating to these Terms or the services shall not exceed the total amount paid by you to Server Heron in the three (3) months preceding the event giving rise to the claim.
Server Heron is not liable for:
- Loss of data, revenue, profits, or business opportunity
- Indirect, incidental, consequential, or punitive damages
- Damages resulting from your failure to maintain backups of server data
- Actions of third parties using or accessing your server
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under mandatory Dutch consumer law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Server Heron, its directors, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the services; (b) your violation of these Terms; or (c) your violation of any applicable law or third-party rights.
11. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you also acknowledge our Privacy Policy.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict-of-law provisions.
Any dispute arising from or relating to these Terms or our services shall first be submitted for informal resolution by contacting us at [email protected]. We will endeavour to resolve disputes within 30 days.
If informal resolution fails, disputes shall be submitted to the exclusive jurisdiction of the competent court in Amsterdam, the Netherlands, unless mandatory Dutch consumer law provides otherwise.
If you are a consumer in the EU, you may also submit a complaint to the Online Dispute Resolution platform of the European Commission at ec.europa.eu/consumers/odr.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or via a notice on our platform at least 14 days before the changes take effect. Continued use of the services after the effective date constitutes your acceptance of the updated Terms.
